1. Acceptance of Terms

By accessing or using FleetOps TFMS ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our Service.

2. Description of Service

FleetOps TFMS is a cloud-based transport fleet management platform providing:

  • Visual load scheduling and planning
  • Driver and vehicle compliance management
  • Part loads deck space management
  • Electronic proof of delivery (ePOD)
  • GPS tracking integration
  • Reporting and analytics

3. Account Registration

To use our Service, you must:

  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Promptly notify us of any unauthorized access
  • Be at least 18 years of age

You are responsible for all activities that occur under your account.

4. Subscription and Payment

4.1 Pricing

Our subscription plans are billed monthly in South African Rand (ZAR). Current pricing is available on our website and may be updated with 30 days notice.

4.2 Payment Terms

  • Subscriptions are billed in advance on a monthly basis
  • All fees are non-refundable except as required by law
  • Failure to pay may result in service suspension

4.3 Changes to Subscription

You may upgrade or downgrade your subscription at any time. Changes take effect at the next billing cycle.

5. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to gain unauthorized access to our systems
  • Interfere with or disrupt the Service
  • Upload malicious code or content
  • Resell or redistribute the Service without authorization
  • Use the Service to process data you do not have rights to

6. Data Ownership

You retain ownership of all data you upload to the Service. By using our Service, you grant us a limited license to process your data solely for the purpose of providing the Service.

7. Service Availability

We strive to maintain 99.9% uptime but do not guarantee uninterrupted service. Scheduled maintenance will be communicated in advance when possible.

8. Limitation of Liability

To the maximum extent permitted by law, FleetOps TFMS shall not be liable for:

  • Indirect, incidental, or consequential damages
  • Loss of profits, data, or business opportunities
  • Damages exceeding the fees paid in the preceding 12 months

9. Indemnification

You agree to indemnify and hold harmless FleetOps TFMS from any claims, damages, or expenses arising from your use of the Service or violation of these terms.

10. Termination

Either party may terminate the subscription with 30 days written notice. We may suspend or terminate your account immediately for violation of these terms. Upon termination, your access to the Service will cease and your data will be handled according to our Privacy Policy.

11. Governing Law

These Terms are governed by the laws of the Republic of South Africa. Any disputes shall be resolved in the courts of Johannesburg, Gauteng.

12. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via email or through the Service. Continued use after changes constitutes acceptance of the updated terms.
